New dock bubbler by-law holds waterfront property owners responsible for injuries
A By-law to regulate Dock Bubblers, Aerators and De-Icers was passed by the Council of the Township of Armour at last Council Meeting.
The By-law regulates the use of the equipment and cautions those persons who operate a bubbler/aerator/de-icer to take steps to ensure that there is no creation of a large expanse of open water extending beyond an area necessary to protect the structure and to take reasonable steps to warn the public of the presence of the open water.
The township says the peril for operators is that should any member of the public suffer injury or damages as a result of the operation of the equipment and the failure of the operator to take reasonable precautions to warn the public, that operator could be held criminally responsible and be exposed to lawsuits for damages.
