LOB repeals Roads License Agreement
Lake of Bays Council approved a new 60-day moratorium for the Road Licence Agreement Program (RLAP) while adopting the new By-law, in the February 11, 2025, meeting.
The By-law was a follow up to the proposed amendments to the RLAP that Council approved last month, and “to establish a policy for the purpose of granting approval to make improvements to a portion of unassumed road allowance or municipally owned land for access to private property within the Township of Lake of Bays,” according to the staff report.
It indicates that the amendments included rewriting the agreement to apply to new access only during the construction period “with no further fees or submission requirements,” and removing existing roads and driveways from being required to enter into an agreement.
It adds that commercial liability insurance will also be required by the Applicant for the road improvements “with the Township as an additional insured during construction.” A minimum of $2 million coverage is required for projects less than 100’ and $5 million for projects over that length.
“The municipality will not assume ownership or be responsible for any maintenance of the improvement (driveway/road),” continues the report.
Council agreed to repeal the old By-law and adopt the new one, which included withdrawing the 180-day moratorium they put in place last August.
They approved the new 60-day moratorium upon staff recommendation for road purchases “so a comprehensive review can be conducted.”
According to the report, staff will be recommending further amendments for consideration by Council in an upcoming meeting.
It adds that the Township will be reimbursing property owners that participated in the program $6,200 for “roads/streets/lanes on plans of subdivision and previously existing privately maintained roads,” and refunds for surveys and claims will occur “on a case-by-case basis.”
Staff indicated that they will also be sending correspondence to applicable residents about the repeal and reimbursements.
